Caught on camera: New Mexico man pulls gun in road rage incident

ALBUQUERQUE (KRQE) – An Albuquerque man was arrested after a scary road rage encounter that was all captured on video. Bernalillo County Sheriff’s deputies said a man driving on I-25 pulled a gun on another driver, in broad daylight.

The road rage victim told KRQE News 13 he was terrified for his life, not only because of the way another man was driving, but what that man did when the victim pulled out his camera.

“I thought this is going to end bad, so maybe I should start filming,” the victim, who doesn’t want to be identified, told KRQE News 13.

“You know, my heart is pounding and I felt like the guy just tried to kill me twice,” the victim added. “Once with his car, and then he’s pointing a gun at me.”

The man is still shaken from what happened Sunday afternoon on I-25 near Tramway. He said he merged into traffic behind a semi. “Next thing I know that BMW is right on my tail honking at me. He kicks it into high gear and hauls butt past me,” the man recalled.

He said the driver of a gold BMW 745i nearly hit his car, drove in front of him and slammed on the brakes.

“We’re on a freeway, you can’t just sit there at 10 miles an hour, and he did this like five more times,” the victim recalled. He said the driver of the BMW “brake checked” him four or five times. “I mean just screeched to almost a stand still.”

The man said the driver of the BMW wouldn’t let him pass to get away. At that point, the victim pulled out his cell phone to try and get a license plate number. As he pulled up next to the BMW, cell phone video captured the driver roll down his window, and point a gun right toward the man behind the camera.

“I mean if they’re crazy enough to pull a gun out, they might be crazy enough to use it,” the victim told KRQE News 13.

He said he slowed down, waited until the last second to exit Tramway and called 911.

“There’s absolutely no reason for that type of behavior on the roadway,” explained Sergeant Aaron Williamson of the Bernalillo County Sheriff’s Office.

Images from the victim’s video led deputies to the driver, 44-year-old Marty Herrera. He was arrested Tuesday night.

“Obviously this individual was so upset that I mean a split second decision, he makes that choice to pull the trigger, and now we have a fatality or a serious injury,” said Williamson.

The man who took the video said he’s seen road rage before, but nothing like this. “He was very aggressive.”

“There’s no reason to go to prison for somebody cutting you off in traffic,” said Williamson.

The image of Herrera holding a gun on the highway shows he has both hands near the gun and neither hand on the wheel. A passenger is seen looking forward as Herrera pointed the gun.

Deputies said Herrera confessed to the road rage incident and handed over his gun to detectives.

Herrera was charged with felony aggravated assault with a deadly weapon, and released on a $15,000 cash or surety bond Wednesday.

Online court records show Herrera doesn’t have a criminal background in New Mexico, but he does have a handful of speeding citations.
